The petitioner has preferred the present revisional application challenging the order dated 18.10.2023 in connection with Misc. Case No. 308 of 2023 under Section 23(2) of the Protection of Women from Domestic Violence Act which was passed by learned Judicial Magistrate, 3rd Court, Ranaghat, Nadia.

Having considered that the said order is subject to an appeal under Section 29 of the Protection of Women from Domestic Violence Act, I grant liberty to the petitioner to prefer an appeal. The appellate court will consider the period of pendency of the present revisional application in respect of any delay which has resulted.

Accordingly, the revisional application being CRR 1754 of 2024 is dismissed as withdrawn.

Pending connected application, if any, is consequently disposed of.

Department is directed to return the certified copy to the learned advocate-on-record of the petitioner after the same is replaced by photostat copy.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
