In pursuance of the direction passed by this Court dated 16.6.2025 a report is submitted by the Deputy Commissioner of Police, Central Division, Howrah, which is handed over by the learned Advocate for the State during course of hearing, 5.
The said report indicates that during pendency of this appeal the appellant Bijoy Krishna Bhattacharyya, was expired on 12.11.2007. 6.
A photocopy of certificate of death of the said appellant was collected and tagged with the report which also affirms the death of the said appellant.

As the appellant Bijoy Krishna Bhattacharyya, has been expired during the pendency of this appeal, the instant appeal stands abated against him. 8.
Let report submitted by the Deputy Commissioner of Police, Central Division, Howrah, be kept with the record.

Thus the Criminal Appeal be and the same is hereby dismissed as abated.
10. Consequently, application if any filed in connection with this appeal is also dismissed accordingly.
11. Let a copy of this order along with Trial Court Record be sent down to the learned Trial Court immediately.
