1. The petitioner is aggrieved by the act of the bank for taking steps to recover the loan amount under the provision of the SARFAESI Act.

2. It appears from the documents annexed to the writ petition, that a proceeding at the instance of the bank is pending consideration before the Debts Recovery Tribunal-III Kolkata.

3. As the issue in question is already pending consideration before the learned Tribunal, it will be open for the petitioner to raise all issues before the said forum.

4. No relief can be granted to the petitioner in the instant writ petition. The writ petition fails and is hereby dismissed.

5. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
