Petitioners have challenged the continuance of the proceedings relating to Nagerbazar Police Station Case No.111 of 2022 dated 7.6.2022.

Records reflect that the investigation of the case has been concluded and charge-sheet has been submitted before the jurisdictional court. None of the documents under Section 207 of the Code of Criminal Procedure are enclosed along with the revisional application. Petitioners are unable to apprise this Court by relying upon certain documents, Petitioners intend this Court to interfere with the proceedings.

Having regard to the materials so submitted by the petitioners being enclosed along with the revisional application, I am of the view that the same are private documents. Accordingly, the petitioners are granted liberty to approach the learned trial court at the appropriate stage by taking out an application under Section 239 of the Code of Criminal Procedure. Needless to state that the learned trial court would consider the said application independently without being influenced by any observations made

by this Court.

With the aforesaid observations, CRR 1701 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
