The defendant in a suit for Ejectment being Ejectment Suit no. 34 of 2014 pending before the 1st Court of learned Civil Judge (Junior Division) at Sealdah is the petitioner of the present revisional application under Article 227 of the Constitution of India.

The evidence of the defendant was closed due to his repeated default in adducing evidence.

The learned Trial Judge by the order impugned being order dated March 23, 2021 has dismissed an application filed by the defendant praying for permission to cite another witness.

The evidence from the side of the defendant since has been closed; there is no scope to grant permission to him to cite another witness.

The learned Trial Judge, therefore, has rightly dismissed the said application. The order impugned does not call for any interference.

C.O. 1260 of 2021 is dismissed without any order as to costs.
