1. Heard the learned lawyers for the parties.
2. We have considered the materials on record. Petitioner is the principal offender. Delay is due to abscondence of co-accused. His bail prayer was rejected earlier on merits.
3. Under such circumstances, we are not inclined to grant bail to the petitioner.
4. Learned Jurisdictional Magistrate is directed to exhaust all processes against absconding accused and declare him as proclaimed offender at the earliest and commit the case to the Court of Sessions.
5. Accordingly, the application for bail, is thus, rejected. (Gaurang Kanth, J.) (Joymalya Bagchi, J.)
