When this matter is taken up, the learned advocates for the respective parties pray that the main civil revisional application be taken up for hearing. With the consent of the learned advocates for the respective parties the civil revisional application is taken up for final hearing by treating the same as on the day's list.

This application under Article of the Constitution of India is at the instance of the objector in a probate suit and is directed against an order being no. 18 dated 21st December, 2022 passed by the learned Judge, 2nd Bench, City Civil Court at Calcutta in O.C. Case No. 6 of 2022.

By the said order a date was fixed for hearing of the application praying for analogous hearing of the probate suit being O.C. 6 of 2022 along with Title Suit

No. 502 of 2019 pending before the learned Judge, 2nd Bench, City Civil Court at Calcutta.

Mr.

Chakraborty, learned senior advocate appearing for the petitioner submits that the application praying for analogous hearing of the two proceedings are still pending and the learned trial judge has not fixed any date for hearing of such application.

Mr. Dey, learned advocate appearing for the opposite party submits that the learned trial judge be directed to dispose of the said application expeditiously. In the light of the submissions made by the learned advocates for the respective parties, C.O. 1464 of 2024 stands disposed of by requesting the learned Judge, 2nd Bench, City Civil Court at Calcutta to take up the hearing of the application for analogous hearing on the next date fixed and to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
