For the NCTE It is submitted on behalf of the petitioners that they have been admitted to the relevant colleges/college for the first semester of the two-years B.Ed. Course under Baba Saheb Ambedkar Education University. It is further submitted that they have been admitted to the colleges through the offline mode. They have also deposited the fees as per the requirement of the colleges and continuing with their studies at the said colleges. The University, however, has declined to register them and allow them to sit for their first semester examination as their names do not feature in the records of the University.
It has been submitted by the University that the petitioners were not admitted through the centralised online mode of the university within the prescribed time limit.
The relevant colleges, however, had proposed to pay a sum of Rs.7,000/- for each of the writ petitioners to the University to regularise the admission of the petitioners to the university.
The University had proposed certain modalities for regularising the admission of the writ petitioners. The parties before this Court have accepted such a proposal. Accordingly, with the consent of the parties, this writ petition is disposed of with the following orders.
By May 2, 2023, the respondent colleges authorities will submit the prescribed applications in respect of the writ petitioners for admission to B.Ed. Programme for the academic session 2022-2024 along with all admission-related documents, scanned signatures and photos of the writ petitioners in a pen drive and the admission fees of students should be paid by bank draft in favour of BSAEU COLLEGE payable at Kolkata.
Additionally, the colleges would pay Rs.7,000/- for each writ petitioner as a penalty and the said payment would also have to be made by May 2, 2023, positively. The said payment would also be accepted in
Bank Draft in favour of "BSAEU COLLEGE" payable at Kolkata.
The respondent University will prepare the list including the writ petitioners pertaining to the respective colleges.
On May 3, 2023 and May 4, 2023, the Principal/Teacher-in-charge of the colleges along with the writ petitioners/students must be present physically before the Registrar of the University will all relevant original documents and Aadhaar cards positively before 4-00 p.m. for verifying the testimonials of the writ petitioners.
The college authorities would submit the registration fees and examination fees through Bank Draft in favour of "BSAEU EXAM" within May 5, 2023, in respect of the students who are found to be eligible for admission.
The Principal/Teacher-in-charge of the colleges must be present with the documents of affiliation for the year 2022.
The Advocate-on-record of the petitioners must hand over the college-wise writ petitioner's/student's list to the Advocate-on-record of University by today before 4.00 p.m.
This arrangement is restricted to the current academic year and shall not create any precedence in the future.
The allegations made in the writ petition are deemed to be denied by the University.
With the aforesaid observations, WPA 10585 of 2023 is disposed of.
