The petitioner's representation seeking refund of the additional 6% GST paid in respect of the work order issued in the year 2022 is pending consideration at the end of the Executive Engineer, Irrigation and Waterways Directorate.

Learned advocate for the State respondents submits that the petitioner will not be entitled to refund of any amount in terms of the Memorandum dated 22nd November, 2022 at page 29 of the writ petition. 3.
Without going into the merits of the claim of the petitioner, the instant writ petition is disposed of by directing the respondent no. 4 to take into consideration the prayer of the petitioner strictly in accordance with the prevailing Rules/ Circular/ Guideline and dispose of the same by passing a reasoned order.

The petitioner shall be provided an opportunity of hearing prior to passing the final order. 5.
Steps shall be taken at the earliest but positively with a period of eight weeks from the date of
forwarding a copy of the order along with the copy of the representation.

If any amount is found refundable to the petitioner, consequential steps shall be taken immediately thereafter.
7.
The writ petition stands disposed of.
8.
Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
