Shree Prakash Mall v. Almighty Advisory Services Llp And Another
18.09.2025 DL-126 CRR 2077 of 2025 Court No.26 (AD) In Re.: An application under Section 442 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (Previously Section 401 read with Section 482 of the Code of Criminal Procedure, 1973).
And In the matter of : Shree Prakash Mall ... ...petitioner Ms. Sutapa Sanyal, Advocate ... for the petitioner
1. Petitioner assails an Order No.2 dated April 21, 2025 passed in Criminal Appeal No.43 of 2025.
2. Learned Advocate appearing for the petitioner submits that, the direction that the petitioner should deposit 20 per cent of the compensation amount is without any basis. She submits that, the petitioner is not a partner of the firm and in any event, did not sign the check involved.
3. Court is informed that, during the pendency of the revisional application the petitioner complied with the direction and deposited 20 per cent of the compensation amount with the Court.
4. In such circumstances, in my view, interest of justice would be sub-served by keeping the point open as to the involvement of the petitioner in the entire episode including the liability of the petitioner to make the pre-deposit of 20 per cent with the appeal court.
5. CRR 2077 of 2025 is disposed of accordingly. (Debangsu Basak, J.)
