The petitioner claims to be an assignee of a sand-mining lease issued by the Government of West Bengal.

Counsel for the petitioner submits that an extension granted to the private respondents, by an order dated 29th January, 2021, issued by the District Magistrate, Bankura is illegal. Counsel for the respondent no.6 submits that extension was granted in terms of an order of a Co-ordinate Bench of this Court dated 21st June, 2019.

Apart from the above, this Court is of the view that the petitioner has no locus standi, whatsoever, to maintain the writ application since in law the lease for sand mining granted by the State cannot be sub-let, assigned or transferred to any third party.

The order dated 29th January, 2021 and a copy of the order of a Co-ordinate Bench of this Court dated 21st June, 2019 are kept with the record.

With the aforesaid observations, the instant writ petition shall stand dismissed.

There will be no order as to costs.

All parties are directed to act on a server copy of this order on usual undertakings.
