Learned Lawyer appearing for the appellant submits that since the appellant paid the entire award money with interest thereon to the respondents/claimants, the appellant does not wish to proceed with the instant appeal. As such, learned Lawyer submits that the appeal be dismissed for non-prosecution.

As the appellant does not want to proceed with the appeal, the appeal may be dismissed for non-prosecution. Accordingly, the appeal is dismissed for nonprosecution. The appellant is permitted to withdraw the statutory amount of Rs. 25,000/- as deposited under Section 173 of the Motor Vehicles Act and interest, if any accrued on the amount from the office of the learned Registrar General, High Court, Calcutta.
