Petitioner is aggrieved as inspite of the order and direction passed by the learned Executive Magistrate no steps were taken by the police authorities.

I have perused the order passed by the learned Executive Magistrate and I find that the direction was for ensuring peace and tranquility and restraining the opposite parties from doing any illegal activities. Police authorities pursuant to the direction in M.P. case no. 596 of 2025 has submitted their report, representations were also made to the police authorities. However, report of the police authorities reflect that a long standing land dispute exists and to that effect a case being O.A. 2418 of 2024 is pending before the W.B.L.R.T.T.

Having considered that the authorities are in seisin of the issue, the prayer of the petitioner for restoration of possession cannot be acceded to. Police authorities, however, would continue their surveillance and ensure that no untoward incidents results because of the inimical relationship existing between the parties. With the aforesaid observations WPA 10547 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
