29.06.2022 cm/ct 28 C.R.M. (DB) 1570 of 2022 sl. no. 36 In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Nabagram P.S. Case No. 154 of 2021 dated 21.06.2021 under Section 420/406/409/467/468/471/120B of the Indian Penal Code.

Rejected And In Re : Nasir Ali ..... petitioner Mr. Milon Mukherjee, Sr. Adv.

Mr. U.A. Dewan Mr. Asif Dewan ...... for the petitioner Mr. Rudradipta Nandy, Ld. A.P.P.

Ms. Sonali Das ...... for the State Petitioner is in custody for 325 days. It is submitted that he has been falsely implicated in the instant case. A website was created behind the back of the petitioner in his name by coaccuseds who are presently in custody. Son of the petitioner had withdrawn cash for his business which was recovered during investigation.

Learned lawyer for the State opposes the prayer for bail. We have considered the materials on record. Petitioner was an employee of the home guard office at Berhampore police line. He entered into a conspiracy with co-accused persons. They prepared a fake website on the strength of forged and fabricated documents and induced unemployed youth to part with money on the false promise of Government employment. The website was created in the name of the petitioner. There are materials to show close nexus between the petitioner and co-accuseds in the crime. Keeping in mind the aforesaid incriminating materials and gravity

of the offence, we are not inclined to grant bail to the petitioner at this stage.

Accordingly, the prayer for bail of the petitioner is rejected. ( Ananya Bandyopadhyay, J. ) ( Joymalya Bagchi, J.)
