Mr. Ambu Bindu Chakraborty Mr. Miru Hazra ....for the Petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division), 4th Court at Howrah to dispose of the Title Suit No. 26 of 2004 expeditiously.

The learned advocate appearing for the petitioner submits that applications under Order 26 Rule 9 and Order 94(C) of the Code of Civil Procedure are pending. Learned advocate appearing for the petitioner further submits that 11th July, 2025 has been fixed for hearing of such applications.

In view of the order sought and proposed to be passed, this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing the opposite parties before the learned Trial Judge.

In the light of the submissions made by learned advocate for the petitioner, CO 1676 of 2025 stands disposed by requesting the learned Civil Judge (Junior Division), 4th Court at Howrah to make an endeavour to dispose of the application under Order 26 Rule 9 of the Code of Civil Procedure and the application under Order

94(c) of the Code of Civil Procedure as expeditiously as possible, if the same are ready for hearing, without granting any unnecessary adjournments to either of the parties.

Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
