Das Mr. Suvadip Bhattacharjee Mr. Rohan Bavishi .... For the Respondent no. 8 Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. The petitioner alleges that the private respondent is obstructing him from raising construction in his own land. He has obtained sanctioned plan from the Panchayat for such construction. The petitioner seeks a direction upon the police authority to act upon the complaint lodged by him. This Court is informed that pursuant to the complaint lodged by the petitioner, FIR has been registered and charge sheet has been submitted upon completion of investigation.

In the event the petitioner is aggrieved by the act of the private respondent, he is at liberty to approach the appropriate forum for redressal of his grievance. In the meantime, the police authority shall keep strict vigil in the area in order to ensure that no untoward incident occurs and there is peace and tranquility in the area. The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
