C.R.M. (M) 402 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, in connection with Kharagpur (Local) Police Station Case No. 976 of 2021 dated 27.12.2021 under Sections 302/201/378/120B of the Indian Penal Code.

And In Re :

Niranjan Shaw ... Petitioner.

Ms. Sampurna Ghosh Ms. Sananda Bhattacharjee Mr. Rohan Bavishi Mr. Saptak Naskar ... for the Petitioner Mr. Ranadeb Sengupta Mr. Ratul Ghosh ... For the State The petitioner is in custody for more than three years and renews his prayer for bail primarily on the ground of his prolonged detention.

Learned counsel for the petitioner submits that there are eighty one witnesses out of whom thirty six witnesses have been examined. The petitioner is not named in the FIR. Learned counsel for the State opposes the prayer. I have considered the material on record which implicates the petitioner in the alleged crime. Thirty six witnesses have been examined. Offences, if proved, shall attract life imprisonment.

Considering the material on record prima facie suggesting involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage. The learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.

The bail application is disposed of.

Case Diary is returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
