Petitioner is aggrieved by the fact that the information furnished with the Officer-in-Charge, Dum Dum Police Station dated 05.04.2025 filed was not acted upon. I find from the information so furnished that apart from the obstruction at the common passage, petitioner was deprived of essential services of supply of water. State has submitted a report. Report reflects that the water tank has been constructed at the outer surface of the house. Police authorities having regard to the nature of the dispute has already drawn up proceedings under Section 126 of the BNSS. Report also reflects that a Title Suit being T.S. 176/25 is pending before the learned Civil Judge (Senior Division), 2nd Court, Barasat. Having considered the totality of the circumstances, I only find that in case there is disruption of water supply, if it is found to have been intentionally committed by any of the parties in that case the police

authorities keeping in mind the same to be a cognizable offence will take steps in accordance with law. With the aforesaid observations WPA 10567 of 2025 is disposed of.

Report so submitted by the State be kept with the record.
