Mr. Ritendra Kumar Jaiswal ...for the petitioners In this application the petitioner has prayed for expeditious disposal of the proceeding under the provision of Protection of Women from Domestic Violence Act, 2005, being A.C. Case No.2610 of 2024 presently pending before learned 10th Judicial Magistrate, Alipore.

It is submitted on behalf of the petitioner that the opposite party no.2 has been adopting dilatory tactics to harass the petitioner by taking adjournments and, therefore, necessary direction may be passed upon the Court below for expeditious disposal of the aforesaid proceeding.

Having considered that the prayer made by the petitioner is innocuous, the service of copy of application upon the opposite party is dispensed with. Considering the fact that Section 12(5) of the Act of 2005 provides for taking every endeavour to dispose of such application within a time limit, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice.

In view of above, the instant application being CRR 1990 of 2026 is hereby disposed of with a direction upon the Court below

to make his best endeavour to expedite the hearing of the proceeding being A.C. Case No.2610 of 2024 and to make his best effort to conclude the entire proceeding preferably within a period of 6 (six) months from the next date of hearing without granting any unnecessary adjournment to either party.
