1. By way of this public interest litigation the petitioner states that tender for allotment of advertising of street hoardings has been done arbitrary by the proceedings dated 13.03.2024.

2. Upon hearing the submissions of the learned advocate for the Kolkata Municipal Corporation, we are convinced that the allotment is only a provisional allotment order and it is subject to the decision of the Departmental Tender Committee and the process is still on.

3. The learned advocate for the petitioner would submit that if there are no bidders from the year 2021 who satisfy the requirements, then the tender condition should have been amended.

4. In this regard it is not for this court to suggest as to how the tender condition has to be amended or not. It is upto the Tender Inviting Authority to take a decision in the matter.

5. Hence, no interference is called for and the same stands dismissed accordingly.
