Heard Mr. P.S. Bhattacharyya, learned amicus curiae, appearing for the appellant and Ms. Z. N. Khan, learned Counsel along with Mr. A. Das, learned Counsel are present for the State. Judgment pronounced in open Court vide separate sheets affirming the conviction and order of sentence recorded by learned Trial Court in respect of the appellant.

As the appellant is stated to be on bail, the bail so granted is cancelled. The Trial Court is directed to take effective step to arrest the appellant to send him to jail/correctional home for serving the remainder sentence.

A copy of the order be immediately sent to 3rd Bench of City Sessions Court, Calcutta in Sessions Trial No. 1 (July)/03 arising out of Sessions Case No. 67/03, under Section 302 IPC along with a copy of the judgment.

Department is directed to supply a free copy of the judgment to Mr. Partha Sarathi Bhattacharyya, learned amicus curiae appearing for the appellant.
