The instant writ petition has been filed by a shareholder of M/s United Vegetable Manufacturer Limited, which the petitioner claims to be a public limited company registered under the relevant provision of Companies Act having its registered office at 18, Zakaria Street, Kolkata - 700073. 3.

The petitioner would complain that the factory premises of the petitioner is presently being demolished by the men and agents of Rishra Municipality. Incidentally, the petitioner has not made the company a party to the present proceedings. No document has been disclosed in the instant petition to demonstrate that the petitioner is competent to represent the company.

Having regard thereto, I am of the view that in the facts and circumstances as noted above, there is no reason to admit the writ petition. The same is accordingly dismissed.

Since, the petitioner's advocate on record seeks leave to file the writ petition afresh on the self same cause of action by curing the defect, I am of the view that dismissal of the writ petition shall not prevent the writ petitioner from applying afresh in accordance with law.
