1. Memo of evidence as submitted be kept with the record.

2. Learned advocate appearing for the petitioner submits that the petitioner has been implicated on alleged recovery of 1720 grams of brown sugar and is in custody for more than 9 months and that there is no possibility of the trial to be completed in the near future. As such, the petitioner may be released on bail.

3. Learned advocate for the State opposes the prayer for bail.

4. I have taken into account the quantum of seizure made and is of the opinion that the rigours of Section 37 of the NDPS Act are applicable in the facts of the present case.

5. Having considered the aforesaid facts, the prayer for bail of the petitioner is rejected.

6. Accordingly, CRM (NDPS) 1004 of 2026 is dismissed.

7. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court.

8. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
