The present revisional application was preferred challenging the proceedings of C. R. Case No. 254 of 2004 under Sections 498A/406 of the Indian Penal Code read with Sections 3 and 4 of the Dowry Prohibition Act. The relevant period when the petitioner approached this court, the case was pending before the learned Judicial Magistrate, 6th Court, Midnapore. The present petitioner happens to be the elder brother-in-law of the complainant/opposite party. Records of this revisional application reflects that initially there was an interim order passed on 17th May, 2005 for a limited period of time. The said interim order was further extended on 5th July, 2005, 13th September, 2005 for a period of three weeks after the Puja Vacation of the said year. The interim order thereafter was never extended and the revisional application is pending before this court for about 17 years.

Ms. Faria Hossain, learned advocate appears on behalf of the State. Mr. Rahul Ganguly, learned advocate appears on behalf of the petitioner. Having regard to the fact that no information could be furnished before this

court regarding the present stage of the proceedings, I am of the opinion that further pendency of the revisional application will not serve any purpose and as such, it is directed that in case the proceedings relating to the Complaint Case no. C. R. Case No. 254 of 2004 is still pending, the learned trial court would grant liberty to the present petitioner to canvass all the points at the appropriate stage which have been agitated in the present revisional application. With the aforesaid observations, the revisional application being CRR 1371 of 2005 is disposed of.
