The supplementary affidavit filed by the petitioners is taken on record.

The petitioners rely an order of a co-ordinate Bench dated 12th May, 2022 in W.P.A.8517 of 2022 by which the petitioners were protected by an interim order by staying of the impugned notice dated 15th March, 2022. The petitioners were asked to remove the constructions on the particular road.

However, documents annexed to the supplementary affidavit show that the interim order is no longer in force. The petitioners in the present proceedings also seek stay of the notice dated 15th March, 2022 issued by the Assistant Engineer, PWD, Haldia Construction Sub-Division No.1.

Since the petitioners have not been able to show any interim order which is subsisting as of today, let affidavit-in-opposition be filed within 9th January, 2023. Reply, if any, be filed within 16th January, 2023. List this matter on 17th January, 2023.

Any action taken by the State in the meantime shall abide by the result of the writ petition.
