The petitioner is in custody for about 40 days and prays for bail.

Learned counsel for the petitioner submits that a civil suit is pending between the parties and both the parties sustained injuries in a free fight which ensued between them.

Learned counsels for the State and defacto complainant oppose the prayer.

I have considered the material on record.

The petitioner appears to be the principal assailant who assaulted the victim with an iron rod causing head injury.

Considering the prima facie role of the petitioner in the alleged offence, prayer for bail is rejected at this stage. The application for bail is disposed of.
