Mr. Subrata Bhattacharya Mr. Arup Kumar Lahiri ..for the petitioner Mr. Satyajit Talukdar ..for the KMDA Learned Counsel appearing for the petitioner submits that the petitioner has preferred an appeal before the KMDA, the appellate authority being the respondent no. 2 in the instant application, but such appeal has never been disposed of till date.

Mr. Talukdar, learned Counsel appearing for the KMDA submits that because of this pandemic situation the appeal could not be disposed of.

Heard both the parties.

The appeal preferred by the petitioner before the Chief Executive Officer, Kolkata Metropolitan Development Authority, being the respondent no. 2 in the instant application made on 8th April, 2021 may be disposed of by the said authority within 3 (three) weeks from date. The respondent no. 2 will give an opportunity of hearing to the petitioner as well as allow the petitioner to produce necessary documents at the time of hearing. The reasoned

order passed by the authority should be communicated by the petitioner within 1 (one) week from passing of such order.

Learned advocate-on-record of the petitioner is requested to serve a copy of this writ petition along with a copy of this order to the respondent no. 2 within 7 (seven) days from today.

The writ petition is disposed of.

There shall, however, be no order as to costs. I make it clear that I have not gone into the merits of the writ petition. All the issues are left open to be decided by the respondent no. 2.

Since no affidavits have been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.
