For respondent nos. 8 & 9 Mr. Rajarshi Basu Mrs. Neelam Singh ... for the State The writ petition has been filed alleging that although, the Kolkata Municipal Corporation called the petitioner and the respondent nos. 8 & 9 for a hearing on the basis of a complaint made by the petitioner, the final decision has not yet been taken by the competent authority of the Corporation. None appears on behalf of the Kolkata Municipal Corporation. Mr. Swapan Kumar Debnath, learned advocate who usually appears for the Kolkata Municipal Corporation is present in Court and is requested to appear in this matter. His appearance may be regularised. Petitioner is directed to serve a copy of the writ petition upon him.

Having considered the submissions of the respective parties, this Court is not inclined to enter into the merits of the dispute as the Kolkata Municipal Corporation has already heard the parties. The Kolkata Municipal Corporation shall

pass a reasoned order within a period of four weeks from the date of communication of this order and communicate the same to the parties. Before passing the order, the municipal authorities may call all the parties interested in the premises for further clarification as it is stated that third party rights have been created.

With the aforesaid observation, the writ petition is accordingly disposed of.

Parties are directed to act on the basis of the server copy of this order.
