(Via Video Conference) Ms. Farnaz Nasim ...for the petitioner Mr. Srijan Nayak, Mr. Suman Dey ...for the State Counsel for the petitioner submits that despite repeated complaints, the Officer-inCharge, Karaya Police Station has not taken any steps in investigating the same nor has registered a formal FIR.

Counsel for the State produces instructions of the Officer-in-Charge, Karaya Police Station and makes submissions. It appears that there are civil disputes pending between the petitioner, his mother, brothers and the family members in respect of the title of the property in question. There are also civil suits pending between the parties.

Karaya Police Station Case No. 449 dated September 26, under Sections 498A/448/341/323/354/ 387/114 of the Indian Penal Code has been registered. There are total three cases including the said FIR in respect of which charge sheets have been filed.

In that view of the matter, the Officer-inCharge, Karaya Police Station is directed to ensure that there is no breach of peace in the locale. The other grievances raised by the petitioner are primarily civil in nature, cannot be dealt with by the police and are left to be agitated before civil fora.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

The instruction of the Officer-in-Charge, Karaya Police Station dated 22.07.2020 be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
