Affidavit of service filed in Court today is taken on record. The petitioner has purchased a plot of land in the year 2020 and claims title thereon. The private respondent also claims title to the said property. The petitioner complains that the private respondent disturbed the petitioner only during cultivation period and not otherwise.

Learned counsel for the State submits that proceedings under Section 107 of the Code of Criminal Procedure have been drawn up against the petitioner as well as the private respondent.

In that view of the matter, since the petitioner has possession of the property, the Officer-in-Charge, Namkhana Police Station, South 24 Parganas shall ensure that there is no breach of peace in the area.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.
