The First Information Report was lodged on 20th December, 1990. Since then the petitioner has not been arrested.
On the submissions from the records made by Mr. Neguive Ahmed, learned Additional Public Prosecutor for the State, we do not think there is any requirement of custodial interrogation of the petitioner.
Accordingly, this application for anticipatory bail is allowed.
We direct that in the event of arrest the petitioner shall be released on bail on furnishing security of Rs. 10,000/- (Rupees Ten Thousand) with personal release
bond of equivalent value to the satisfaction of the arresting officer.
The petitioner will also comply with the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
We impose further conditions that:
(a) The petitioner shall appear before the court below and pray for regular bail within a period of four weeks from date.
(b) The petitioner shall deposit Rs. 36,000/- (Thirty Six Thousand only) representing the amount allegedly misappropriated by him in such account as the investigating agency might indicate to the petitioner without prejudice to his rights and contentions.
