The petitioner was the Secretary of the Lodhan Sunflower Sangha Women SHG Primary Co-operative Society Ltd. (hereinafter referred to as the said society). The petitioner has challenged a resolution and a notice issued by the Board of Directors, on the basis of which the petitioner was compelled to step down from his post of Secretary of the said society. The petitioner continues to be a member in the Board of Directors. The dispute, which has been raised, must be adjudicated in terms of Section 102 of the West Bengal Co-operative Societies Act, 2006.

The petitioner is directed to raise a dispute with regard to the allegations contained in the writ petition in terms of Section 102 of the said Act. If the same is raised, the competent authority having jurisdiction, shall dispose of the said dispute in accordance with law, upon hearing all the parties, within a period of four months from the date of submission of the application. The decision shall be communicated to all the parties.

This Court has not gone into the merits of the claims and counterclaims of the parties and all points are left open to be decided in accordance with law.

The writ petition is, thus, disposed of.

There will be no order as to costs.

All parties are to act on the basis of the server copy of this order.
