By way of supplementary affidavit, the learned Advocate for the appellant sought to contend that the appellant does not intend to proceed any further with the instant case and a letter received by him is annexed thereto.

In view of the above, the appeal is dismissed for non-prosecution.

Interim order, if there be any, stands vacated.
