No. 29 CHC Rejected C.R.M.(A) 1885 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Gangarampur Police Station Case No. 79 of 2018 dated 31.03.2018 corresponding to Special Case No.15 of 2018 under Sections 21(c)/22(c)/23(c)/27A/28/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

And In the matter of : Subhankar Bhowmick ...... petitioner Mr. Amitabha Ghosh ....for the petitioner Mr. Ranabir Roy Chowdhury, Mr. Sandip Chakraborty ....for the State Police case is dated March 31, 2018.

Commercial quantity of narcotics was seized.

Police filed charge-sheet.

Considering the long absconsion of the petitioner in respect of the police case and materials in the case diary, we are of the view that petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985.

Consequently, we are unable to grant anticipatory bail to the petitioner.

CRM (A) 1885 of 2023 is rejected.
