The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with.
The named executor of the alleged last Will and testament of one Bela Sen failed and neglected to apply for the grant of probate of the said Will, as such, the opposite party nos. 1 to 6, being the beneficiaries under the said Will, have applied for grant of letters of administration.
The said proceeding being L.A. Case No. 02 of 2019 is pending before the Court of the learned District Judge, Hooghly.
The petitioner is complaining delay in disposal of the said proceeding.
It appears from the record that there are some interlocutory applications. A substantial time has already been consumed to revoke the earlier grant of
probate, as such, the learned District Judge is requested to dispose of the said pending interlocutory applications and the said proceeding, in accordance with law, as expeditiously as possible, and in doing so, shall not grant any unnecessary adjournment to either of the parties.
C.O. 1475 of 2024 is disposed of with the above terms without any order as to costs.
