The petitioner complains of police over-action. Learned senior advocate for the petitioner submits that, the petitioner was called to the police station in respect of a commercial dispute without any basis. Learned advocate appearing for the State submits that, the police received the complaint on the basis of which, the police conducted a preliminary inquiry. The petitioner was called to the police station on the process of such preliminary inquiry. Such preliminary inquiry revealed that there is dispute of civil nature between the private parties. The private respondent is represented.

Learned senior advocate appearing for the private

respondent submits that, his client lodged the complaint with the police station as against the petitioner for cheating. In the facts of the present case, since the police concluded the preliminary inquiry and found that the disputes between the private parties are civil in nature, no interference is called for by the Writ Court. The private parties are at liberty to avail of their remedies before the appropriate forum, in accordance with law.

WPA 11413 of 2021 is disposed of accordingly without any order as to costs.
