Petitioner being widowed daughter has approached this Court with the present writ petition claiming family pension in view of death of her father on 30th June, 2021. Father of the petitioner was an Assistant Teacher in a Government aided secondary school who was receiving pension and according to the petitioner, death of her father on 30th June, 2021 confers right upon her to receive family pension being widowed daughter.

On query being posed to the learned advocate representing the petitioner about relevant documents e.g. legal heir certificate and income certificate, since those are not part of the writ petition, it is not shown that these documents are submitted before the concerned respondent authority. For settling family pension case of widowed daughter of a deceased teacher submission of income certificate and legal heir certificate issued by competent authority is required.

Writ petition stands disposed of granting leave to the petitioner to submit relevant documents before the District Inspector of Schools (S.E.), North 24 Parganas being respondent no.3 at an early date. If those documents are submitted, it is expected that respondent no.3 shall take steps, in accordance with law, for settling family pension case of the petitioner.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
