Petitioner Mr. Arup Kumar Bhowmick ...for the petitioner Mr. Krishnendu Bhattacharya Mr. Somnath Bera ...for the State Learned counsel appearing on behalf of the petitioner submits as follows. The alleged victim had been found taunting a girl. The parents of the victim girl and others caught him and asked his parents to come. The boy was allegedly humiliated at that place. Soon thereafter, after returning home, he committed suicide. The petitioner has been falsely implicated in this case.

Learned Additional Public Prosecutor relies on the case diary and opposes the prayer for anticipatory bail. He refers to the FIR, the statements of witnesses, some of whom have also made statements before the learned Magistrate, and the post-mortem report. According to some witnesses, it appears that the victim and his friends including the girl in question, had gone somewhere. While coming back, they were intercepted by the parents of the girl, as well as others. The victim was assaulted and publicly humiliated. The present petitioner was one of the persons who tried to disrobe the

victim by opening the zipper of his pant. Unable to bear such humiliation, the victim boy subsequently committed suicide. Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
