1. Affidavit-of-service filed in Court today is taken on record.

2. On perusal of the order dated 16th February, 2026, it transpires that the factum death of the complainant/opposite party no. 2 was placed before this Court by the petitioners but as none appeared to represent the opposite party no. 2, direction was given to the State to furnish a report in this regard.

3. It is arising out of a complaint case shows the State is otherwise not a necessary party and none submitted any report on behalf of the State. Even though, the order was communicated to the office of the learned Public Prosecutor, High Court, Calcutta.

4. Today before this erstwhile learned advocate representing the opposite party no. 2 appears and

files the death certificate and submits that the opposite party no. 2 has expired. Let the same be kept with the record.

5. In considering the submissions made before this Court, the death certificate furnished on behalf of both the petitioners as well as learned advocate so represented the opposite party no. 2, this Court accepted the factum death of the opposite party no. 2.

6. Therefore, apparently no other furnish questioning the factum of death of the said opposite party no. 2, hence, there is no reason to further keep this matter pending, which is of the year 2023.

7. In view of the above, the instant revisional application stands dismissed being abated.

8. The petitioners are directed to place the facts and the order before the learned Court for passing appropriate order.
