13.06.2022 sdas rejected C.R.M. (DB) 1589 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Santuri Police Station Case No. 84 of 2020 dated 16.11.2020 under Sections 302/34 of the Indian Penal Code.

And In Re : Mutuk Murmu & Anr. ..... petitioners Mr. Chandra Sekhar Bag Mr. M. S. Mandal ... for the petitioners Mr. P.K. Datta, learned APP Mr. Santanu Deb Roy ... for the State Learned Counsel appearing for the petitioners submits that they are in custody for eighteen months. It is also submitted that there is no direct evidence connecting the petitioners with the alleged crime.

Learned Counsel appearing for the State opposes prayer for bail.

We have considered the materials on record including the statement of the supervisor of the pump station who stated that the petitioners were present along with the deceased on the fateful night at the pump site. Subsequently, on their leading statement, their blood stained wearing apparels were also recovered.

In view of the aforesaid incriminating materials and the gravity of the offence, we are not inclined to grant bail to the petitioners at this stage.
