Petitioner(s) Mr. Antarikhya Basu Ms. Madhumita Basak ... for the Petitioner(s) Mr. Shataroop Purkayastha ... for the State-respondent(s) Learned advocate for the petitioner submits that the subject-matter of the case involves alleged recovery of 100 bottles of phensedyl. Learned advocate also submits the petitioner has been implicated only on the basis of statement of a co-accused. Learned advocate added that the petitioner is in custody for 93 days and the prosecution in the charge-sheet has relied upon 14 witnesses in order to prove its case. Therefore, learned advocate prays for bail on any stringent condition.

Learned advocate for the State opposes the prayer for bail but is unable to refute the contention that the petitioner has been implicated only on the basis of statement of a co-accused.

I have taken into account the factum of 14 witnesses relied upon by the prosecution as also the fact that witness action is yet to commence.

Having regard to the fact that some time will be required to take the trial to its logical conclusion, I am inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Abdul Hakim Sardar @ Hakim Sardar shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act, 6th Court, Barasat, North 24 Parganas.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of North 24 Parganas without prior permission of the learned Special court/trial court.

Accordingly, CRM (NDPS) 1007 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
