Affidavit-of-service and notice of service in respect of mentioning for inclusion before this court, filed in court today, be kept on record. In view of the innocuous nature of the prayer made by the petitioners, further service on the respondent is not being directed.
The petitioners' grievance is that the petitioner's application under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter referred to as "the SARFAESI Act") pending before the District Magistrate at North 24 Parganas has not yet been taken up for disposal, despite a previous direction of this court.
Hence, WPA No. 10119 of 2022 is disposed of by requesting the District Magistrate, North 24 Parganas to take up for hearing and dispose of the application filed by the petitioners under Section 14 of the SARFAESI Act, as annexed to the writ petition, as expeditiously as possible upon granting an opportunity of hearing to all concerned and in accordance with law, preferably within four weeks from the date of communication of this order to the District Magistrate.
There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
