Learned advocate appearing for the petitioner is 07.07.2025 Court No. 35 M/L. No.10 Rakib aggrieved that although an order of status quo have been passed in connection with Title Suit No. 191/2015, a direction have been passed upon the Officer-in-Charge, Magrahat Police Station but no steps have been taken by the police authorities to respect, obey and implement the order of the Civil Court. Petitioner apprehends that he may be thrown out of the property.

State has submitted a report. Report reflects that the respondents also purchased half of the suit land and has constructed a dwelling by filling up low lying area. There are land related disputes, as such the police authorities have drawn up proceedings under Section 126 of the BNSS.

Having considered the plight expressed by the petitioner and the nature of the dispute, I direct that if there are any violation of the status quo order passed by the learned Civil Judge (Senior Division), Diamond Harbour in that case for breach of such directions

petitioner would approach the jurisdictional Civil Court, no interference is required by this Court except to the extent that the police authorities would continue their surveillance and ensure that no breach of the peace and/or tranquility takes place.

With the aforesaid observations WPA 10695 of 2025 is disposed of.

Report submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
