Mr. Pratap Kumar Yadav ...for the petitioner In this application the petitioner has prayed for a direction upon the Court below for expeditious disposal of G.R. Case No.45 of 2021 presently pending before learned Additional Chief Judicial Magistrate, Kakdwip.

Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that the petitioner lodged a written complaint on 2nd January, 2021 which culminated into Namkhana Police Station Case No.01 of 2021. After completion of investigation, police submitted chargesheet on 31st May, 2021. Since then charge hearing has not been conducted by the Court below. Prosecution proposes to examine only 8 witnesses.

Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite parties will have no cause to prejudice, and, as such, service of copy of application upon the opposite parties is hereby dispensed with.

Having considered submissions made on behalf of petitioner and also considering the fact that after submission of charge sheet on 31st May, 2021, further proceeding of the case has stalled for a period of more than 5 years, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice.

In view of above, the instant application being CRR 2006 of 2026 is hereby disposed of with a direction upon the Court below to make charge hearing on the next date fixed or within a period of 30 days thereafter. In case of absconding of any accused, the Court below shall split the record in respect of the absconding accused and thereafter shall proceed with charge hearing.
