Mr. Sudip Sarkar Mr. Sukdeb Sarkar .....for the respondent no.6 The petitioner has alleged inaction on the part of the Baruipur municipality in granting water connection to the petitioner on a portion of holding no. 563, Ward No.8 under the Baruipur municipality. The municipality has accepted Rs,4,995/- as cost for the domestic water connection. Such cost was accepted some time in 2012.
It is submitted that the petitioner and the respondent no.6 are joint owners of the premises and they are enjoying their respective portions. It is further submitted that the respondent no. 6 has raised objection with regard to grant of water connection and as such the water connection could not be given.
It is submitted on behalf of the respondent no.6 that the water connection has been supplied to
the premises by the Baruipur municipality up to the common point.
Be that as it may, this Court is of the opinion that the water connection should be reached to the premises of the petitioner by the municipality and the respondent no.6 shall not create any hindrance. Such connection shall be given upto the same point, as has been given to the respondent no.6 or from any convenient point. The cost of such connection from the common point to the premises of the petitioner shall be borne by the petitioner. If the cost of water connection has gone up, then the municipality will be entitled to charge the enhanced amount upon deducting the amount already deposited.
Parties shall enjoy the water connection without interfering and/or obstructing each other. The municipality shall complete the entire process within a period of two months from the date of communication of this order.
The writ petition is, thus, disposed of. There shall be no order as to costs.
