Sri Pasupati Baidya The second appeal tender is of year 2001. The defect was reported on 14th December, 2001 to be that plaintiff's legal representatives were named as appellants. Plaintiff had been mentioned as party in both the decrees. No substitution application was filed. There was order made on 31st August, 2004 by coordinate Bench saying as follows:- "Steps be taken pursuant to the office report dated 12.9.2003 by two weeks from date. In default, put of for final orders.

Inform the learned Advocate for the appellant." Pursuant to above order, intimation was issued on 16th September, 2004. None appears on behalf of appellants. In view of aforesaid, we are convinced that named appellants have lost interest to prosecute the appeal. Final order is passed.

SAT 2243 of 2001 is dismissed along with connected application.
