IN THE HIGH COURT AT CALCUTTA

Item No.13 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 1564 of 2012 (Via Video Conference) Panchu Gopal Mondal versus State of West Bengal & Anr.

In Re: An Application under Section 482 of the Code of Criminal Procedure, 1973.

This revisional application was preferred challenging the proceedings arising out of Domjur Police Station Case No. of dated 08.12.2011 under Sections 403/406/417/418/420/466/467/468/120B of the Indian Penal Code as well as the first information report. The records of this revisional application reflect that the revisional application appeared on 04.07.2012 and 12.09.2012. I do not find that there is any interim order restraining the proceedings so far as the investigation is concerned.

Earlier on 13.09.2021 when the matter was called on, Mr. Debapratim Guha, learned advocate appeared on behalf of the petitioner and prayed for an accommodation. Today, when the matter has been taken up, the learned advocate for the petitioner does not participate in the proceedings. None also appears on behalf of the State. As such, no information has been furnished regarding the outcome of the investigation and whether the police authorities after nine years have filed charge-sheet or final report before the jurisdictional court. So far as the contents of the FIR are concerned, prima facie,

materials surfaced thereby deterring this Court to interfere in this matter.

Accordingly, the revisional application being CRR 1564 of 2012 is dismissed.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
