Mr. Sourat Nandy ...for the petitioner Mr. Krishnendu Bhattacharya, ld. APP Ms. A. Chakraborty ....for the State Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that this is a second application for anticipatory bail. Earlier, on 12.11.2025 the application for anticipatory bail of the present petitioner and some others was turned down by this Court in CRM(A) 3450 of 2025, while the application for anticipatory bail of some other petitioners was allowed. Now, charge sheet has been submitted. Learned APP representing the State relies on the case diary and opposes the prayer for anticipatory bail. He submits that a charge sheet has been submitted under the same provisions under which the FIR was registered. Therefore, there is no material change in circumstances warranting consideration of a second application for anticipatory bail. Moreover, there are incriminating materials available against the petitioner, including the statements of at least three witnesses.

Considering the above, the other incriminating materials available in the case diary and the fact that this is a second application for anticipatory bail without there being any material change in circumstances, I do not consider this to be a fit case for granting anticipatory bail.

Accordingly, the second application for anticipatory bail is, thus, rejected.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
