Having regard to the averment made in paragraph no.8 of the application, I am of the view that the petitioner has sufficiently explained the delay in filing the restoration application.

Accordingly, CAN 2 of 2024 is allowed.

Re: CAN 1 of 2024 This is an application for restoration.

Having regard to the averments made in paragraph nos. 3 and 4 of this restoration application, I am of the view that the petitioner has sufficiently explained the reason for his non-appearance before this Court on May 22, 2024.

Accordingly, CAN 1 of 2024 stands allowed and WPA 10701 of 2023 is restored to its file and number. Re: WPA 10701 of 2023 Learned advocate appearing for the petitioner submits that the petitioner made a representation against the decrease of his monthly salary from Rs.19,000/- to Rs.9,000/- per month as Data Entry Operator of Ragunathpur-II Panchayat Samity.

Learned advocate appearing for the State submits that the petitioner's service has been discontinued and his salary also has been stopped. In that view of the matter, I dispose of this writ petition granting liberty upon the petitioner to challenge his discontinuation of service by the authority in accordance with law.

Accordingly, WPA 10701 of 2023 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
