1. By this public interest litigation the petitioner alleges that appropriate action should be taken for transfer of the criminal case before the competent CBI court involving an alleged murder of a victim boy.

2. The learned Government counsel appearing for the State submitted that the de facto complainant in the criminal case has already filed a writ petition before this court being WPA 10878 of 2023 and the matter is now pending before the learned Single Bench.

3. In the light of the fact that the de facto complainant being actually the aggrieved party has already approached this court by way of a writ petition, we are of the view that on the same issue a public interest litigation need not be entertained.

4. Therefore, the writ petition stands disposed of leaving it open to the said writ petitioner to canvass all the points in the pending writ petition.
